Update on AHS vs AUPE Labour Dispute

Yesterday AUPE released an update on the matter about the ongoing complaint filed by Alberta Health Services (AHS) (representing PCA and RA) against the Alberta Union of Provincial Employees (AUPE) with the Alberta Labour Relations Board (ALRB).


What’s the issue?


AHS (represents PCA and RA) filed a complaint alleging that AUPE’s Auxiliary Nursing Care (ANC) unit engaged in unfair labor practices during its recent ramp-up in preparation for potential strike action. They claim AUPE’s communications (e.g., letters, notices) pressured employees into joining the strike, violating Section 60(3) of the Alberta Labour Relations Code, which prohibits intimidating employees into strike participation. AHS is asking the ALRB to declare this an unfair practice, stop AUPE’s communications, issue a retraction, and cover legal costs.AUPE’s response


AUPE defends its actions, stating their communications were lawful, aimed at informing members about their rights and the importance of collective action during a legal strike. They argue their messages are protected under the Canadian Charter’s freedom of expression and that AHS hasn’t provided evidence of coercion. AUPE is asking the ALRB to dismiss the complaint, calling it an attempt to undermine their bargaining power.


Neither AHS nor AUPE has explained why this matter wasn’t clearly communicated to employees/members, especially after an AHS email and AUPE bargaining update in April 2025 that contradicted each other.


What's next?


A formal hearing is scheduled for October 27–30, 2025, to resolve the matter. The ALRB will review both sides to determine if AUPE’s actions crossed the line. We’ll keep you posted on any developments. For now, both parties are standing firm in their positions.
